This Refund Policy explains when Emargy may approve or deny refunds for digital products, software licenses, downloads, renewals, subscriptions, and custom services. Because digital products can be delivered immediately, refund eligibility is limited.
This Refund Policy should be read together with our Terms of Use, Privacy Policy, and any applicable checkout terms.
1. Digital Product Refund Window
You may request a refund for a digital product within fourteen (14) days of purchase only if all of the following conditions are met:
the product has not been downloaded;
the license key has not been activated;
the product has not been installed, used, tested, copied, modified, or integrated;
the license has not been used to request updates, downloads, API validation, or license verification;
no support, troubleshooting, implementation, consultation, diagnostic review, or custom work has been performed for that purchase.
2. Non-Refundable Digital Product Cases
A digital product purchase is generally non-refundable if:
the product file has been downloaded;
the license key has been activated or used on any domain;
the license has been used for update checks, downloads, API validation, or support entitlement;
the refund request is made more than fourteen (14) days after purchase;
the issue is caused by third-party hosting, themes, plugins, unsupported modifications, server restrictions, security rules, cache systems, external APIs, payment gateways, or misuse;
the purchase was made to test, inspect, copy, reverse engineer, temporarily use, benchmark, resell, redistribute, or duplicate the product;
the account is connected to abuse, fraud, license sharing, unauthorized access, chargeback abuse, false information, policy violations, or violation of our Terms of Use.
3. Technical Issues
If a product does not work as described, contact us with details before requesting a refund. We may ask for the product version, WordPress version, WooCommerce version, PHP version, server environment, error messages, logs, screenshots, installed plugin/theme context, and temporary diagnostic access where appropriate.
If we confirm a material defect that prevents normal product use and we cannot provide a reasonable fix, workaround, update, or compatibility explanation within a reasonable time, we may approve a refund even if the product was downloaded or activated.
A refund will not be approved where the issue is caused by unsupported environments, third-party systems, user modifications, incorrect installation, blocked server requests, missing requirements, or refusal to provide reasonable diagnostic information.
4. Duplicate Purchases and Billing Errors
If you accidentally purchase the same product or plan more than once, or if there is a clear billing error, contact us as soon as possible.
We may refund the duplicate charge, cancel the duplicate order, or apply account credit at our discretion.
5. Renewals, Subscriptions, and License Extensions
Renewals, license extensions, support renewals, and subscription payments are refundable only if requested within fourteen (14) days and no renewal or subscription benefits have been used, including:
new downloads;
product updates;
support requests;
license validation;
additional activations;
continued access to paid features or services.
Unless required by applicable law, failure to cancel a renewal or subscription before the renewal date does not automatically qualify the payment for a refund.
6. Custom Services
Deposits, discovery fees, audits, consulting sessions, strategy work, emergency work, implementation work, development work, design work, migration work, and project milestone payments are non-refundable once scheduled, started, delivered, or used to reserve time, unless a separate written agreement says otherwise.
If a project is cancelled before work begins, Emargy may, at its discretion, refund unused amounts after deducting payment processor fees, administrative costs, third-party costs, planning time, reserved capacity, and work already performed.
7. Restricted Jurisdictions and Sanctions Compliance
Emargy does not provide products, services, subscriptions, licenses, downloads, support, custom work, or business relationships to customers, users, entities, projects, or beneficiaries located in, resident in, operating from, or connected to restricted jurisdictions.
Restricted jurisdictions include, but are not limited to, Cuba, Iran, North Korea, Syria, Crimea, Luhansk, and Donetsk, as well as any other jurisdiction, person, entity, or activity restricted by applicable sanctions, export control rules, payment processor policies, or financial compliance requirements.
By purchasing from Emargy, you confirm that:
you are not located in, resident in, operating from, or ordinarily based in a restricted jurisdiction;
you are not purchasing on behalf of any person, entity, project, organization, or beneficiary located in or connected to a restricted jurisdiction;
the product or service will not be used for, delivered to, resold to, transferred to, or made available to any person, entity, project, organization, or beneficiary in a restricted jurisdiction;
you will not use Emargy products or services in violation of sanctions, export controls, payment processor rules, or applicable law.
If Emargy determines, suspects, or receives notice that a transaction, account, order, project, user, beneficiary, or payment may involve a restricted jurisdiction, Emargy may immediately reject the order, cancel the service, suspend or terminate the account, revoke licenses, disable downloads, stop support, and refund, void, or decline the transaction where appropriate.
A refund may be denied if the customer provided false, misleading, incomplete, or evasive information regarding location, identity, project purpose, end user, beneficiary, or compliance status.
8. Compliance Reviews and Account Verification
Emargy may review orders, accounts, payments, license activations, support requests, billing information, customer information, project details, IP-related signals, domain information, and other available indicators to help prevent fraud, abuse, sanctions risk, restricted jurisdiction activity, or violation of our Terms of Use.
We may request additional information before approving access, continuing service, or processing a refund. Failure to provide reasonable requested information may result in cancellation, suspension, rejection, or denial of a refund.
9. How to Request a Refund
To request a refund, contact [email protected] or use the contact page. Include:
your order number;
billing email;
product or service name;
purchase date;
reason for the request;
relevant technical details, screenshots, logs, or error messages;
any information reasonably requested for compliance, fraud prevention, or account verification.
10. Review and Processing
We review refund requests case by case. Approved refunds are normally returned to the original payment method.
Payment processors and banks may take additional time to post the refund, commonly five (5) to ten (10) business days after approval.
Payment processor fees, currency conversion differences, bank fees, taxes, and third-party costs may not be recoverable in all cases.
11. Effect of Refund
If a refund is approved, Emargy may deactivate the related license key, revoke downloads, close support entitlement, cancel updates, void invoices where appropriate, and require you to stop using and delete the product files.
After a refund, you are not permitted to continue using, copying, modifying, distributing, reselling, or relying on the refunded product, license, download, documentation, or related materials.
12. Chargebacks and Payment Disputes
If you open a chargeback or payment dispute without contacting us first, we may suspend the related account, license keys, downloads, updates, subscriptions, and support while the dispute is reviewed.
Fraudulent, abusive, false, or bad-faith disputes may result in permanent account restrictions, license termination, service refusal, and denial of future purchases.
13. Fraud, Abuse, and Policy Violations
Emargy may deny refunds, suspend accounts, revoke licenses, or refuse future service where an account, order, payment, or refund request is connected to:
fraud or attempted fraud;
abuse of refunds or chargebacks;
unauthorized sharing or resale of licenses;
false billing or identity information;
restricted jurisdiction activity;
sanctions or export control risk;
misuse, copying, reverse engineering, or redistribution;
violation of our Terms of Use, checkout policy, or payment processor requirements.
14. Consumer Rights
Nothing in this policy limits mandatory consumer rights that cannot be waived under applicable law.
Where mandatory consumer protection laws apply, those rights will apply only to the extent required by law.
